Jens Hills & Co., specialist media and entertainment litigators, have issued proceedings
in the Royal Courts of Justice, Chancery Division on behalf of Matthew Fisher against
Gary Brooker and Onward Music Limited for inter alia a declaration that Matthew Fisher
is the co-author of the music in the song entitled "A Whiter Shade of Pale".  The Royal
Courts of Justice
served the Claim Form and Particulars of Claim on Gary Brooker and
Onward Music Limited on the 31st May 2005.

Update - 14th December 2005

The parties have now exchanged pleadings setting out their respective cases which has
resulted in an order being issued by the Chancery Division of the High Court of Justice
instructing that the trial take place on a date between 1st July 2006 and 20th November 2006.

To Whom It May Concern

It has come to my attention that a number of incorrect and defamatory allegations
have been made against my wife, Carol Fisher (née Bellantoni).

It is alleged that she instigated both my departure from Procol Harum in June 2004,
and my current legal claim relating to "A Whiter Shade of Pale".

Neither of these allegations has any truth or substance whatever.

My wife has in fact always advocated the greatest circumspection before taking
any major decision or embarking on any irreversible course of action.

The decisions I have made and the actions I have taken have been mine alone,
and her sole influence, for which I thank her, has been to advise me
to think deeply and carefully before acting.

I hope this statement will set the record straight, and I would remind those concerned
that allegations appearing on Internet websites are deemed to have been
'published', under the terms of the laws relating to defamation.

The trial is now concluded and we await the decision of Mr Justice Blackburne.
